The process of litigation begins when a plaintiff files a complaint. The complaint is based on facts and legal theories upon which a plaintiff relies when seeking relief. The person being sued is given a period during which they can respond and defend themselves against the claims made. Additionally, the defendant may file a counterclaim.
Understanding the Discovery Process
Parties exchange information regarding the case through this process. Both parties are obliged to respond to the discovery and can conduct a discovery. The process allows those involved to request for specific documents, ask for written responses to written questions, and ask for oral responses to questions given under oath. Discovery is important since it allows parties to go to full trial with the facts so that they are not surprised during the trial.
How is the Cased Decided?
A judge or jury can decide the case during the trial. Additionally, the defendant could move to have the case dismissed based on a legal deficiency. Besides that, the parties may opt to resolve the issue out of court.
